Hello everybody. I would really appreciate if somebody could answear my question. I have dual nationality - EEA and recently I have became British. Me and my husband we have been married for 5 yeras and 1 month now so i am assuming that my husband is eligible for BC now? Can somebody confirm that my thinking is right? My second question is about his PR. He did not apply for PR because he got it automaticly but my question is how should we prove his PR? Is my PR card enough that I obtained in 2011 or should we provide proves for 5 yeras exercisig Treaty Rights? Thank you in advance for your help:-).

Your PR card is enough.

Hi, I have PR as well and I'm about to apply for BC this month but I have hold my PR for 12 month since March 2013. I believe that you should be married for 6 year ( 5 yrs RC + 1 yr PR) after 5 yrs marriage your EEA hubby automatically get PR ( presuming treaty right ) and wait 12 months, unless the rules are changed!!
Applied for EEA4 on 24/02/2012.
HO received on 27/02/2012.
Refusal received on 16/08/2012 dated 11/08/2012
At the court, the HO REP withdrawn the decision and asked me to send the DOC for the time before marriage.
PR dated 05/03/2013

Tnak you Jambo and Spike_Uk for your prompt answear. I think that my husband's situation is little bit diffrent than your Spike_Uk because I have BC so we can skip that 12 months waiting after PR for my husband but thank you anyway :) .

there is a loophole. loophole is : BC spouse don't need to wait 1 year after PR . so in this case your husband can apply after 5 years 1 day in the as an EEA family member

EU Settled Status: Confirmed on 16th July 2019
Naturalisation : Confirmed on 02nd Oct 2020
Passport Approval : 21st Feb 2021

This is not a loophole but the law. The law is different if married to BC.
