I am an employer trying to recruit someone on 36 and now 40 points. I wrote to my MP, who wrote to the Minister responsible. Here is the reply from the Assistant MP Account Manager at the UK Visas and Immigration and Her Majesty's Passport Office, not really saying anything I didn't already know. I thought people might find it useful:
Dear [MP's name]
Thank you for your letter of XX February to the Immigration Minister with enclosures on behalf of [me] who is concerned that the limit given to Tier 2 skilled workers is adversely impacting his business. Your letter has been passed to me to reply as agreed with your constituency office.
I should explain that due to the dramatic increase in applications for all occupations within the Tier 2 limit, the points required for a Restricted Certificate of Sponsorship (Restricted CoS) at recent allocation panels has been above 45 points; compared with the threshold of 21 points required at almost all of the previous monthly allocation panels.
Mr X's correspondance suggest that the solution to this would be to increase the monthly allocation temporarily to meet demand. We keep all immigration routes under constant review and whilst we acknowledge Mr X's suggestion, the total number of Restricted CoS are divided into monthly quotas to ensure that certificates are available throughout the year; as set out in the Immigration Rules.
The annual limit is 're-set' in March 2018, with the new 2018/19 monthly allocations becoming available in April 2018. As set out in the Immigration Rules, the provisional monthly allocation for the April 2018 panel is higher than the allocation in recent months. There are certificates available and X can re-submit their application for inclusion in the next monthly panel.
