After all the advice I have received from this board I have decided that I am going to go back home to all those who dont know here is my back ground.

i am an asylum seeker who is still awaiting HO to approve / or disapprove second asylum claim but have not heard anything for over 8 months.

My partner to whom i am traditionally married and not legally married to but have been living with for a little under 6 years has ILR and we have an 22 month old son.

I want to now give up and go home with my son and although i am still together with the father will mean us separating and he does not want to be separated especially from his son. If push comes to shove and I insist on going back is there any chance that he can contest and the law rule that my son can stay with his father.
