Parental responsibility

Dear All,

Please, can anyone clarify the case of parental responsibility.

I've got a 5 years old son but I'm not married to his mother.
However we ale living together and I'm listed on the birth certificate.

Am I correct to say, that based on the information from www.gov.uk and Wikipedia I've got full parental responsibility?

I'm wondering if I do need my partner signature for my son's Passport Application or I can sign it myself.

This extract from the guidance notes explains what is required :

If the child’s parents are not married, the
mother can give permission. The father can
sometimes give permission but usually only if he:
̐ has a parental responsibility order or agreement
(which must be sent with the application)
̐ has a residency order
̐ is named on the birth certiﬁcate (which must
be sent with the application), and the birth
was jointly registered on or after:
– 5 April 2002 in Northern Ireland
– 1 December 2003 in England and Wales, or
– 4 May 2006 in Scotland.

We are Polish. I've got BC and my son too.

This is what I mean. They say 'sometimes'.

My partner had to go back to Poland. She will need to stay ther for couple of weeks and during that time my son's Polish passport will run out.

I don't want to go to Poland just to renew his Passport - to expensive.

I was hoping to get British Passport for him and send it to them by courier.

You should be able to apply for his passport as a parent.

Also, as the process for passport applications from abroad is changing and applications from Poland now need to be made directly to IPS anyway, I believe you can just apply within the UK and send the passport by courier (that's what IPS would also do).

My point is that when I'll apply from here I can use Premium service and have a passport within a week or two. From Poland it would take at last twice longer.

Yes, I'm named on the child's birth certificate and it was registered jointly after 1 December 2003.

Then you can give permission for the application. They will need to see a copy of the birth certificate.

You will be doing the IPS Fast Track Service so go to https://www.gov.uk/ips-regional-passport-office and find the office you'll be going to. Ring them and confirm that you've got all the correct documents before you arrive.

Yes. If the child is UK born, there is no need to certify the birth certificate, just use the long version which lists you as the father
