BC application questions - absences/selfemployment/spouse

Post by peteOpete » Wed Apr 10, 2013 3:52 pm

Hello all,
I have a few questions related to BC application

I will be completing my 1 year period of being in ILR by the 5th of May this year. I was present in UK exactly before 5 years. So I believe this condition of my application is satisfied. Further questions I have about the application are:

1. In the last 5 years I have been outside the UK for 456 days in total – out of which about 370 was for official purposes. Will being upto 456 days an issue for my application?

2. I recently started my own limited company (in Feb 2013). Till then I was employed in a company who used to pay my taxes and NI. I will only be doing self assessment by Jan 2014. So I am not sure what documentation I should show for this purpose as I am currently self employed.

Now the other set of questions I have is about my wife and child. They are currently on FLR (M). They are eligible to apply for ILR as soon as my wife gives her Life In the UK test (scheduled for end of April). My wife has completed 3 years as well. My questions are:

1. I am assuming if I want my whole family to apply together for BC, then I will have to wait till my wife completes her one year in ILR as well – is this right?

2. Am I right in understanding if I get through my BC application in about 6 months time (estimated timeframe for application process) she can immediately apply as the spouse of BC – is this understanding right?

3. Is it better for me to wait till my BC is completed to apply for my wife’s ILR – her FLR is valid till middle of next year- or can I apply for her ILR soon after my BC application (through NCS) ?

4. My little one was born outside UK – she also is currently on FLR (M) – what is the procedure for her BC ?

I would really appreciate your input in the above questions.

Thanks.

1. For naturalisation there is no difference between business related absences and personal ones. However, 456 days is fine (although the threshold is 450, upto 480 is normally disregarded).

2. None.

1. If applied together, your wife needs to complete 5 years of residence, not 3.
2. Yes. (and BC application takes 1-2 months on average).
3. Her ILR is not affected by your BC application.
4. She will need ILR and can apply once your wife has also ILR.

I suggest you read the FAQ.

Hi Jambo,

Thanks very much for responding to my questions. Much appreciated.

I have gone through the FAQs - thank you.

So in effect, I really don't have much documentation to take for my application - I can't think of many

Regards
