SET(O) form queries

Post by diamond2013 » Tue Nov 05, 2013 10:16 pm

Hi,

I am due to apply for ILR in Jan under Tier 1 General) category throughout. I have few questions while filling the SET(O) if experts can help me please?

1) Section 6 - 6.1
When did you (the main applicant) first enter the UK? This
refers to the date of your first entry into the UK at the beginning
of the period of stay on which this application is based.

I first entered the UK on WP in Feb 2008 and stayed here till Aug 2008, then went to India and applied and received Tier 1(General) in Feb 2009 and entered UK in March 2009. I am considering my qualifying period to start from March 2009 till date because there was a gap of more than 6 months since my first visit but from March 2009 it is fine. So, the question is should I mention Feb 2008 or March 2009 in this question?

2) While filling the dates and reasons of absences
None of my absences exceed 180 days in 1 year and in total I have 275 absences spanned across different years

- I have 2 gaps of 16 and 19 days in which I had resigned from my
company here so I went to India before I joined the next company -
what reason should I write for these absences?

- I have 43 absences in which I was on paid annual holidays ( in different intervals) in which I was in India -
should I get a letter from all my previous companies to state the dates
for holidays?

- I went to India for 60 days (including 15 annual holidays) while I was
working from home in India but was paid in GBP here - should I take a
letter from my company stating the same?

- I went to Paris for 1 full day and 2 half days for holidays, but there was
no one to stamp my passport, though I got a stamp when returned the
UK. I don't have any proof of itinerary etc. but only my passport as I
went by package tour in a ferry and bus. Do I need to worry about it if I
mention this 1 day absence in the form?

- I also went on holidays for 2-3 days to Isle of Man (Crown
dependencies) Do I need to mention about it in the absences and
section 6.9. Also I do not remember the exact dates as it was in 2009.
Please note we don't get passports stamped if we go to Isle of Man.

3) Section 6.11 says
Please give the dates of any absences spent outside of the Crown
Dependencies and the UK.

I have already given details of my absences in 6.2 which were outside
UK and Isle of man, what should I write in this?

It would be great if experts can take out sometime to answer my queries

Regards

March 2009

Usually people have not been asked for letters if the absences are less than 180 days in 1 year

Visiting family in India

- I have 43 absences in which I was on paid annual holidays ( in different intervals) in which I was in India -

Get one if you can, otherwise as I said above people haven't been asked yet to provide if less than 180 days in 1 year.

- I went to India for 60 days (including 15 annual holidays) while I was
working from home in India but was paid in GBP here - should I take a

You can

- I went to Paris for 1 full day and 2 half days for holidays, but there was

UK. I don't have any proof of itinerary etc. but only my passport as I

You should mention all period of absence greater than 1 full day outside UK

- I also went on holidays for 2-3 days to Isle of Man (Crown
dependencies) Do I need to mention about it in the absences and
section 6.9. Also I do not remember the exact dates as it was in 2009.

thanks a lot suds19 for your reply.

Can you or someone please tell me something about my last question as well?

According to Section 6.9 -6.11 It looks like they want to know if someone was working in any of the crown dependencies, but I just went for holidays.so not sure what to say in that section.
