MN1 or S3 form and some other questions

Post by UK2013A » Thu Nov 14, 2013 11:14 am

Hi All,
I have been granted ILR on 10 years long residency basis.
I have a few questions regarding registration of my two kids – they born in UK.

My situation is;
I married (Islamic marriage) to someone who overstayed in UK and came to UK on spouse visa. Her relationship never established or even started with her previous spouse as the marriage was kind of a forced family marriage. She received a divorce letter (not official) from her previous spouse when she returned back to Pakistan as things were not going along between them.
Long story short – she came back to UK and we started our family life and now living together with two kids. My Mrs and one of my oldest child has a discretionary leave to remain (have applied for extension – awaiting decision) We were advised by a solicitor that we could not legalise our marriage until My Mrs gets an official divorce through court in UK. I never register my kids with Pakistani high commission.

So now my questions are;
*Can I apply for registration of my kids?
*If yes, then what form I would complete MN1 or S3 – Based on Section 1(3)?
*If I complete MN1, should I put nationality of kids as Pakistani?
*If I apply through post – do I need to send my original passport and Biometrics card or a photocopy will do? UKBA has announced changes to documents requirement on 12th Nov that originals are not compulsory for MN1 application!
When I apply for their registration do I need to mention about their application to UKBA for discretionary leave to remain?
Can I apply for child benefits etc now or I have to wait until they get registered first?
I would be highly appreciated if seniors, sages, gurus, moderators etc look into this and guide me through please.
I want to apply for the kids ASAP as I have to make urgent travel to Pakistan with kids.
Kind Regards

As they were born after 2006, your marital status is irrelevant as long as you are named as the father on the birth certificate. Apply using form MN1 (section 1(3)). If they are Pakistani put that or just leave blank. You can send photocopies. Their current immigration status is irrelevant.
