Tier-1 General switching to Long Residence for ILR

Post by javid231 » Tue Jan 07, 2014 11:19 am

Hi Guys,

I tried to find an answer but couldn't find a post here.

I'm currently on Tier-1 General and will be applying for ILR in March next year in 2015. I have my wife and children under 18 who joined me 4 years ago and by March next year (2015), they will complete five years in the UK as my dependents.

In September this year (2014), my stay in the UK will be 10 years long which means I can apply for ILR on the basis of long residence instead of applying in March 2015 as Tier-1 General.

My question is whether my children and my wife will be affected by this as I think their immigration status will now change and if I apply on the basis of long residence, my wife will not remain my dependent but spouse and in this case, she will need to wait for further five years to be eligible for ILR. Also, I will need to fulfill the maintenance conditions etc for that duration.

Will someone please guide me in the right direction.

Many thanks
Javid
