I am not specialist in that area, but given the fact that you have EU/Irish children you should secure a residence card for you.
The problem I see is that you current application is based on your spouse exercising EU treaty rights, which she might not be (depending on how long she spent working in Ireland before becoming unemployed). I am not sure what the process is to applied based on your Irish child but I assume it is a different form to send to a different section of INIS (lets see if someone her can clarify).
I think the best thing would be to make sure whether she is considered as exercising Treaty Rights or if she can find another job quickly; in which case you aer fine. But otherwise you might have to submit another application based on your children.
For how long have you and her been in Ireland, and can you give a bit more details about her periods of employment and
unemployment?
Hi Jeupsy.
Thank you for your reply.
We have arrived in ireland in september 2013 and soon after my wife started work. She used to work almost 3 months and during her employment I have applied for my card which was issued successfully. In 16 of december she lost the job.
Not very long ago, about a week ago she found another job and she submitted her P45 to new job, but We don't know whether she continues working or not as work is night shift and it is very awkward struggling with 4 children on my own. That's a story i am sharing, you asked me.
Even If i apply due to my irish child, I don't know would I be issued another card or not. In this case i have to refuse for this card (from my wife) in order to apply as a parent of irish child. If no card issued out of my child and I refuse for card out of my wife I die:))
Thanks
