ILR Eligibility for Dependent

Post by jilpangs » Thu Jan 23, 2014 10:01 pm

Hi,

I'm in TIER2 ICT for past 5 years holding valid visa till 16-04-2015. My wife & kid as dependents also have valid dependent Visa till 16-04-2015. We all hold Biometric Card.

I'm now eligible for applying ILR but since my wife was away for nearly 10 months (not for pregnancy though) she is not eligible now.

So if i apply for ILR, what will happen to my wife's current Visa? Will it get invalid because it was provided based on my Work permit Visa?

Alternatively, in last 5 years - My wife had spent 1233 days in UK & 592 days out of UK.
592 days outside UK were spent in 3 chunks. 1 - 264 days, 2- 33 days, 3- 295 days.
Will she be still eligible for ILR along with me as she had lived in UK more than 2 years in last 5 years i.e (365X2=730 days) in UK.

Please clarify.

Thanks
Raj
