ILR question

Post by Omo1978 » Thu Mar 06, 2014 4:59 pm

Hello,

I have a question about qualifying for ILR that I will really appreciate your help. Find below my scenario

Visa Type:- Tier 1
Issued Date:- 20th May 2010 Expired 20th May 2012
Renewed visa:- 2nd July 2012 to Expire 2nd July 2015

Due to pregnancy and delivery of my daughter (Birth Date:- 24th Jul 2010), I could not entered the UK until the 3rd November 2010(she was 3 months old ). Even though my husband (Dependant visa) entered the UK on 20th June 2010. Since moving to the UK, I have only been away for less than 10 days.

Will I be qualified for ILR in June 2015 (Say end of June 2015) stating that I could not move within the 90days entry grace period due to illness as a result of the pregnancy?

I will greatly appreciate your kind contributions.

I believe the grace period is only upto 90 days, which you did not manage to keep. I think you may need another extension before you can apply for ILR. Your husband was dependent on your visa and his entry do not substitute your grace period. I could be wrong and would recommend you wait for someone else to respond.
All the best x
