Child born in UK to parents with ancestry visa

Hello,

My husband and I (both Australians living in the UK) are expecting our first child, and are trying to figure out the citizenship and visa requirements.

I hold an ancestry visa, and my husband is a dependent on my visa. Our visas will expire in 2017.

So far, I have gathered that our child will not be eligible for British citizenship. Can anyone please confirm this?

I am aware that we can apply for Australian citizenship by descent and an Australian passport while we are in the UK, but we are getting stuck at the visa step as we cannot contact anyone from the Home Office.

Old posts on this forum suggest that we should use the FLR(O) form, but this form does not seem to be designed for our situation. I am also unclear as to what this would get our baby. Will they have a visa that will allow them to stay as long as our current visas? Or, will we need to reapply every year, or every time we want to re-enter the UK?

You're right that the child won't be british.

Absolutely spot on. The necessary application form to fill, is also attached at the bottom of the link.

Child can only be registered as British Citizen once you have acquired ILR.

Do you know what the FLR(O) form will entitle my child to? Will they be able to stay as long as we can, and travel in and out of the UK freely?

Here's an advanced question for you: can we lodge the application from Australia, or is it best to do it from the UK?

The application will entitle the child to the same rights as you.

You can only make an Entry Clearance application fromAustralia, not a FLR (O).

A child who is born in the UK can apply for LTR in line with his/her parents leave: 306.

Thanks again! This is very helpful.

I managed to speak to the Home Office, and they confirmed that we should use the FLR(0) form if applying from the UK, this is despite a current error on their website which gives a link to a different form for people on the PBS.

They also confirmed that we could apply for entry clearance from Australia, but I can't find much information online. Does anyone know where I can find the appropriate form?

If you don't intend to travel a British born child does not require any leave to remain.

Hopefully HEZBEZ may see this.
Just wondering how it all went because my wife and I are in the same position.
Is it 600 pound to add a child to your ancestry visa??
Just looking for an accurate cost please and if it is form FLR(0)
