Hi,
My name is adnan.....can anybody plz help me out regarding my visa application...
i have applied FLR(M) application on 01/07/2014. i was on appeal on enterpreneur but i withdrawn my appeal before sending FLRM application. Basically i want to ask is that do i need to go back to my country to re-apply visa or they can switch my visa from here in uk...and how long they will take to make a decision....
i will be very thankful to anybody who will help me..........

Depends if you applied for FLR(M) within 28 days of leave expiring/previous application being refused.

yes i applied within the 28 days infact after the withdrawal of my appeal the very next day i sent my case....and yes my previous visa was rejected but some lawyers told me that if you do not have valid leave to stay here u cant get FLRM visa from UK, you need to go back......i am only worried about this thing......

I'm not sure about the dates. When did your last leave expire, what date did your T1 application get refused and what date did you apply for FLR(M)?

i got refusal on T1 in may 2013 and then i launched my appeal which was held for almost 1 year then i withdrawn my aapeal in june 2014 last month and by 01/07/2014 i applied for FLR(M).

do you have any idea that in FLR(m) application applicant must have valid leave for 6 months atleast. I asked my lawyer he told me that u can switch your visa from here even if u dont have a valid leave.....i am bit confused....

No you don't need 6 months valid leave. Did your solicitor advise you to withdraw the appeal?

Yes he advised me to withdraw the appeal first then apply for FLRM....becz i wanted to carry my appeal as well with FLRM.....but he told me that home office will straight away reject ur case if u do so.....

You should be ok as you've applied within 28 days of withdrawing your appeal. You couldn't make a new application with an appeal pending.
