ILR BRITISH WIFE AND DAUGHTER CLAIMING CHILD BENEFIT

Post by AKritee » Tue Jul 15, 2014 11:25 am

Hi, I am applying for ILR under 2 years route this month
my wife is a british citizen and we had baby on 1-04-2014 so my child is also a british citizen. my wife claimed child benefit and the money come to her bank account (we do not have joint account).

As child benefit comes under public fund, will it affect my visa? should i call hrmc to stop the benefit ?

please help asap

No it won't affect your application. She is entitled to claim

You should tick for child benefit - your partner

Hopefully you're submitting more than a gas and electricity bill as proof of joint address. You need 6 pieces of evidence from 3 different sources, spread as evenly as possible over the two years.
Are you saying you have your earnings paid into your father-in-law's bank account or that you pay for your gas and electricity bills in cash after they're debited from his account? :?

YES I HAVE MORE DOCUMENT
I GOT LITTLE WORRIED WHEN I READ SECTION 12 OF THE APPLICATION FORM
NON OF OUR EARNING GETS PAID INTO HIS ACCOUNT

WE PAY THE RENT TO HIS ACCOUNT EVERY MONTH
ME AND MY WIFE IS THE ACCOUNT HOLDER OF GAS AND ELECTRICITY (STATEMENTS COMES UNDER OUR NAME)
BUT THE BANK ACCOUNT IS MY FATHER IN LAW'S THOUGH WHICH WE PAY THE BILLS SO IT WILL APPEAR IN HIS BANK STATEMENT

You're not asked to show which bank account pays the utility bills. You're only submitting the bills as proof of joint address.

Well HMRC regard child benefit as untaxable income but there are others on the forum, especially Amber, who would be able to confirm this for immigration purposes.

Yes Child Benefit and/or Tax Credits can be used as income for adequate maintenance. Insofar as child benefit is being claimed by the sponsor or in some (seldom) cases the applicant where the applicant has an exception. Savings can also be used to support adequate maintenance.
