Visa expired outside UK and new visa applied with in 28 days

Hi ,



I have been working in UK with ICT Tier 2 visa since Nov-2009 and my
work is like onshore(UK) and offshore(India) model, so I had to work few
months in UK and few months in India. Since I had two entry clearance
in the period of 29/Jun/2009 to 30-Aug-2011 I have a confusion about my
ILR

Please see my below visa and travel details

VISA 1

Visa Type : VISA TIER2(INT COM TRAN) MIGRANT
Visa Valid from and To : 29/Jun/2009 to 14/July/2010
First Entry and stayed in UK : 01/11/2009 to 13/12/2009
Left UK : 14/12/2009( I went to India for my baby delivery and also
maintaining the offshore team)

Second Entry and stayed in UK : 04/04/2010 to 15/05/2010
Left UK : 16/05/2010 (I went to India for maintaining the offshore team and had to spend 3 months)

As I had to spend time in India for the above reason unfortunately my
visa got expired on 14-July-2010 and applied new visa on 08-Aug-2010(
within 28 days from my previous visa expiry date).See below details

VISA 2 (Applied in India with in 28 days, from my first visa expiry
date)

Visa Type : Tier 2 (ICT T2 Established Staff)
Visa Valid from and To : 16-Aug-2010 to 30-Aug-2011
Entry and stayed in UK :5-Sep-2010 to till date (Visa Extended twice
in UK)


Am I eligible for ILR?
