Can A HSMP (judicial Review) Spouse dependant apply for ILR?

Please i need your advise on this.
My spouse got his hsmp in 2006(he is covered by the judicial Review), but for reason of absence days in the UK, he has not been able to get his ILR.
My question is this, can I as a spouse who has continually spent 5years in the UK apply for my ILR independently?
Please your urgent response will be highly appreciated.
