Travelling outside UK while MN1 pending

Post by Subtle » Tue Oct 21, 2014 11:50 am

Can I please get an expert opinion on this.

Me and my wife have applied for ILR and hopefully (fingers crossed) we would receive it in the next month. We have a baby born here and I would apply her British Registration (MN1) as soon as I get the approval.
As I understand, is it true that the baby can travel outside of UK (on her original nationality passport) while the registration application is still pending at Home Office?
If the application gets approved while the baby is outside UK, can she enter UK without visa? What proof would she require at the borders to prove she is registered as British national?

Thanks

No, the child would need a visa as usual. The only way the child could enter other than getting a visa is with a British Passport.

Thanks. But she wouldn't be able to apply visa for UK as she would already be a British National? Or am I missing something else here?

Then apply for a passport via fast track (which is 1 week) once citizenship is granted.

Alternatively, apply for a Certificate of Entitlement or Right of Abode in the foreign passport in the country where the child is after citizenship is approved and you have received the certificate of Registration.

What is the nationality now?

The child should be able to enter the UK if she manages to get to the border by showing her registration certificate . The issue might be getting on a flight if she is a visa national.

Thats a very valid point. Even if somehow we manage to get UK border understand the situation but it wont be easy to make other border forces to understand that the baby doesn't need a visa.

I think it would be prudent to wait a little bit longer and get a passport before travel.
