Re-Applying for EEA Family Permit - for third time

Post by mradam » Wed Nov 12, 2014 9:45 am

Hello Everyone,

I have a few questions regarding the EEA Family Permit application, I will be grateful for any advice.

My situation is as follows:

- I am a French citizen, living in the UK for many years (Permanent Resident)

- My wife is a Non-EU national (from Pakistan)

- We applied for a EEA Family Permit for the first time in October 2013; this was REJECTED

- We applied again, for the second time in April 2014, this was ACCEPTED

- The EEA Family Permit is valid for 6 months and when it was granted to my wife on the second application, the expiry date was in the first week of November 2014

- Unfortunately, my wife was not able to make use of the EEA Family Permit to travel due to various reasons, and the Permit has now expired

- We are now planning to re-apply for a third time for a EEA Family Permit

My questions are as follows:

- Are there any restrictions as to the number of times an individual may apply for an EEA Family Permit?

- Does she need to provide reasons as to why she did not use the EEA FP to travel to the UK in the 6 months that it was valid?

- Will her case be dealt with a greater level of strictness considering it will be the third application?

- Have the rules changed in any way that will affect how we apply this time? (last time I provided proof of my Permanent Residency and proof of our marriage and it was OK; will I need to include anything else as part of the application this time?)

- And finally, my wife and I have been married since 2011, but due to her being in Pakistan and me in the UK, we have not been together all this time, though I have made a few trips to visit her and we keep in daily contact via things like Skype, WhatsApp etc... Will I have to provide extra proof and/or explanation that we are indeed in a bona fide marital relationship due to the time elapsed since the marriage (3 years +) ?

Many thanks in advance!

My questions are as follows:

- Are there any restrictions as to the number of times an individual may apply for an EEA Family Permit? NO

- Does she need to provide reasons as to why she did not use the EEA FP to travel to the UK in the 6 months that it was valid? NO, BUT IT WOUDLN'T DO ANY HARM TO MENTION IN THE COVER LETTER

- Will her case be dealt with a greater level of strictness considering it will be the third application? NO

- Have the rules changed in any way that will affect how we apply this time? (last time I provided proof of my Permanent Residency and proof of our marriage and it was OK; will I need to include anything else as part of the application this time?) NO, AS LONG AS YOU'RE NOT A BRITISH CITIZEN.

- And finally, my wife and I have been married since 2011, but due to her being in Pakistan and me in the UK, we have not been together all this time, though I have made a few trips to visit her and we keep in daily contact via things like Skype, WhatsApp etc... YOU ALREADY GOT THE EEA FP IN 2014; IF YOU DIDN'T NEED TO PROVIDE ANYTHING AT THAT TIME, YOU WON'T NEED TO NOW.

Many thanks in advance!
