Spouse visa - absence from UK question

Post by Candle tree » Sun Jan 04, 2015 4:46 pm

Hi,
Can someone help me with following question:
I have a spouse visa (granted April 2013), I have long to go till ILR since I am on a 5 year system (2,5 yrs + 2,5 yrs).
My husband has been offered a job transfer to Canada. Obviously, I want to go with him. We plan to stay there for a year and then return to UK. What are the implications on my visa, if any?
Thank you.

You would need to re-apply for entry clearance (because presumably, your visa will expire and you cannot extend it from outside the UK). This will reset your 5 year ILR clock.

thank you very much for reply.
ouchhh!
however, my time away will be within visa time. as it happens, i would move once i get extension and return way before it expires. Does that mean i will not need to reapply for entry clearance ?
And presumably apply for ILR (with explanation why i was absent) or apply for further extension?
as a wife i will be wherever my husband is.
