Mn1 form for my daughter

Post by Joannabl » Mon Feb 09, 2015 8:19 pm

Hi everyone

I would like some information on the mn1 form for my daughter. I have done my own research but just want confirmation if i have all the relavent information before i apply.

Ok so my story
I am a eea national from poland. I first came here in 2002 as a au pair and i do have my original visa to come work here. Then the rules changed and i no longer needed a visa to work in the uk. Anyway i had my daughter in 2004 with my then partner who is a british citezen by birth. We were never married. But now i want to register her as a british citizen.

My daughter could not then register as a british citezen because i was not married to her dad. And so she took my polish citizenship.

I understand with some rule changes now. That under the home office descretion i can register her as a british citezen.

So i need to fill in mn1 form based on her dads name (as he is a british citezen) and provided her full birth certficate which has both out names on.

Is there anything else im missing??
Anybody else in the same situation as me who can share some information or experience

Most appricated
Many thanks

If your daughters father was British at the time she was born in UK than your daughter is British citizen otherwise than by descent.
I am sometimes wrong.

No @milan69, that's not the case as the child was born before 1 July 2006 and the parents were not married at the time, and are still not married.
However, as @Joannabl said, the child can now be registered as British based on having a British father. Registration is at discretion under section 3(1) of the British Nationality Act.

The following requirements need to be met:
- proof of paternity needs to be supplied (e.g. birth certificate or DNA test)
- having consent of all those with parental responsibility
All information given is just my opinion as a member of this forum and does not constitute immigration advice.

And so all i need to do is fill in form accompanied with birth certificate and letters from me and my ex partner with consent to the resgistraion of our daugther.

Also if registration is unsuccessful do i get the money back?
