App Refused due to Tax return Covering more than 12 Months

I sen My application on the 9th of July and got it back on the 14th of August only to be refused due my ******** caseworker she said and I quote
"The two pieces of evidence you have supplied do not corroborate each other because they do not cove the exact same period. The wage slips cover from August 2004 to July 2005 and the tax return you have provided covers the period January 2004 to December 2005"

Even here in the Uk where the tax returns is issued every april of the year, If I am claiming for a period of January to December I ll have to combine two tax returns(p60) which extend before and beyond the 12 period claiming for.

I am working on the appeal letter right now and I hope to fax it out to them on monday.

I got 60 points as claimed for other sections except for the past earnings.

Anyone had a similar experience.

Hi there.

This result is what I would have expected them to do. You should only send a P60 (April to March) if your earnings match the exact dates.
Otherwise, you should only send bank statements to match the dates of your salary claimed. You then do not need to send any tax documents.
I do not think your appeal letter will thus work; you should reapply with your 12 month bank statements showing the salary entries along with your pay slips.

Thanks for the reply, the country in question is Nigeria and this issue of tax returns applies to all nigerians submitting application for hsmp, and mine should not be an exception. Various people from nigeria has aplied using the same kind of documents but this has never been an issue.
Please also not that the guidiance not did not state that the tax return must cover only and only this 12 months period. that is it must be limited only to this period.

It is mandatory to submit tax returns but you should NOT have ticked the box in Q33 in the Previous Earnings Section. You should still have submitted the tc, leave the box blank and then seek exceptional consideration and then attach a letter from your employer stating your earnings for the period claimed, your payslips, and then probably your bank statement.

By ticking the box in Q33 against: Income Tax return covering period claimed for, you are asking the case worker to consider the tc as evidence

Thanks for the reply, legally speaking The guidiance notes state that if the tax return you are submitting does NOT cover the period you are claiming for, that is when you should supply a letter from your employer detailing how much you earned as salary for the whole 12 months period.

If there is no rule that says something is not then it is.

SAAyinla,

Explain clearly in your review that the tax year of your country is from the 1st January - 31st December and that this varies across the world.Also, refer to only documents/evidences you have provided.Don't include any new doc. This has happened to me too in 2006 and I explained clearly to them. You can also fax this review to them.the fax nos can be found on the HO website.You should call them immediately you send the fax to confirm the nos of pages received.I hope this helps. @ Saayinla - what evidences were submitted to claim points along with ITR?

@ Makon and Saayinla - It is okay if you tick the tax box Q.33 but make sure you mention in the exceptional consideration that you are providing either your bank statements or employer letter - that is if you are claiming for the 12 payslips you submitted and your ITR you submitted is not covering the claimed period...
