Discretionary Leave Extention advice

Post by connie500 » Wed Feb 25, 2015 10:18 pm

Hello,

I first posted back in 2011see below link

http://www.immigrationboards.com/immigr ... 77006.html

Quick Summary

I am a British national
Partner was a 5 yrs overstayer he came to uk in 2006, i met him in 2007
8 months sentence for possession of false passport in 2011
sent to detention centre after sentence and given removal directions
Appealed removal on article 8 grounds (a carerer / father figure for his disabled nephew, been in a relationship with me since 2007, I was unable to travel due to sickness and frequent hospital appointments)
Went to immigration court
Won case
Partner Granted discrectionary leave til June 2015

Within this time we have now got married but My question now is could he be refused his renewal because I am no longer Ill as I have read that renewal of discretionary leave is based on the exact reasons it was given in the first place. All other facts from initial appeal above remain the same.

Will the fact that we are now married affect Home Office decision

Any advice would be much appreciated
