Exemption from KOLL in case ILR received after 28.10.13

Post by sals82 » Mon Mar 16, 2015 10:08 pm

I received ILR in Dec 2013, and I think at that time the requirement for KOLL (the new rules) was
- to have passed life in UK test and
- to have a degree equivalent to UK batchelors degree

I need to apply for citizenship now, and reading the latest KOLL requirements, it looks like you need to
-pass life in UK test and
-have a degree which is at least UK Batchelors equivalent + it was taught in english.

I have a BCom degree, which PBS does not recognise as batchelors, but it gives 10 points for the degree for english
I have a CA degree as well, which PBS gives zero points for english and zero points for level of qualification. However, i have a letter from Naric which states it is equivalent to UK master degree.
As such, i have 1 degree which is recognised on PBS being taught in english(but not recognised for batchelor equivalent); and another degree which is masters equivalent but no english points.

I want to avoid going to naric for ELA.

My questions:
1 - guidance from home office says that if you met KOLL requirement when you were granted settlement after 28 oct 2013, then you dont need to meet the KOLL again at the time of citizenship application. Does that mean i dont need to do anything and i am good for citizenship application?

2 - if answer to 1 is negative, then can i meet the koll requirement combining my 2 degrees, without getting any additional naric docs?

3. If answer to 2 is negative, then what is the best solution?

Many thanks

1. Yes, I believe since your ILR is after 28 October 2013 you should be fine.
Being British is a state of mind.
