Refused FLR FP

Post by Ayeshaabbas » Thu Mar 19, 2015 3:56 pm

Hello All

Please help me with my situation

I have received my documents from Home office today and they have rejected my application and given me until the 8th April deadline to appeal.

I came to UK in Jan 2013 as wife for my husband who was international student at that time. I cam on Student Dependent visa. My husband applied for his ILR long Residence and got his residence recently. We applied for my FLR FP because we couldnt satisfy income requirement for FLR M as my husband wasnt working (was studying) and i was the one only working (total income 14000 per year).

We dont have any children. The home office rejected application saying that they dont think we have insurmountable circumstances not to got back to Pak.

please help me with these questions:

1) What is the best way for me to delay this process? i am thinking that if i can delay this process for 6 months then after this time i can vary my application to flr m since my husband will have a stable job then. Somebody told me that there are tricks to delay your process such as sending the documents always on the last day whenever you are given a deadline from HO. Is that correct?

2) What will happen if my appeal gets rejected? Will the HO gives me 60 or 30 days to leave the country?

3) How much time it normally takes to get a court hearing when you submit over the appeal documents?

4) what happens to my work right during this time and will i be able to reply apply for flr fp or flr m if the Judge rejects my appeal?

Please help

u can get about one year time during appeal.seniors correct me if i am wrong
send ur appeal when 2 days left for deadline(do recorded delivery) u will get 4 to 5 months time to get hearing time

after hearing judge will take 3 days to post decision, and GOD forbid if ur appeal unsuccessful u can ask ist tier for permission to appeal to upper tribunal,u can use the form which will come with court decision with 14 days (send same before 2 days deadline )

they will also take 4 to 6 week to grant u or refuse permission, if they refused u can apply direct to upper tribunal within 14 days ,but if they give u permission u will get more time for ur case to be listed for hearing again.it will give u extra time.

Manchester Piccadilly has a significantly shorter waiting time than London.

From experience it is 2months waiting, whiles London is 7-8 months, which may allow you and your husband to get you finance in order.

thanks for your comments

is there any way we can put london address during appeal process?

i am worried that if we do then in future it might cause problem when the time comes to apply for flr m because we would not be able to show proof of couple residence in london

if we are proceeding our case through a london lawyer then cant we put london address in that case as the lawyer cannot come to manchester

please advise if there is any other way

thanks
