EEA application from UK Spouse Visa

Hi Helpful members,

Please assist with the below:

So I'm currently due to go on appeal for the decision made on my ILR application which is linked to my now expired UK spouse visa application. I'm no more with my British wife - for other reasons entirely.

Now, I intend to withdraw the appeal, as I do not have a solid ground for it to be honest.

In its place, - based on advice by a solicitor - I plan on submitting an (Unmarried) application on the basis of my relationship with my EU partner. We have been together for almost 2 years now and just started living together (close to 2 months).

Question:
- Is this something I can do?
- If I go down this route (EEA). Do I still maintain my right to work?
- Lastly, is there any point of doing this if we don't get married immediately? I'm hesitant on rushing it. Ideally, I would like to wait a bit. Don't want to give the impression I'm getting married again after my divorce from my first wife (which would be due soon by the way).

I await all response.

Please, since no reply. Am I of the impression I've asked a stupid question and all I need to do is more research? If that's the case, a sign and I will do more research.

Felt I should ask and to verify the advice given hence the post.

Very weak.
Extended family members of EEA nationals wrote:Evidence required for durable partners
The applicant and the EEA national sponsor must have been living together in a relationship similar to marriage which has subsisted (continued in existence) for at least two years.

Thanks a lot Vinny.

So, what would make the argument strong, asides marriage? Living together at least 2 years - is this actually strong enough? Or marriage is the only way to strengthen my application?

Also, as my divorce was not finalised by the time my current partner and I were in a relationship. Will this be counted as 'time spent together'?
