ILR long residency dependant

ILR long residency dependant

Dear friends,

I would greatly appreciate any ideas on this,

I obtained my indefinite leave to remain in the UK through Long Residency in June 2015 and i was on Tier 2 general and my partner is currently on Tier 2 PBS which will expire on 31st August 2017. Can she remain on this visa and then switch to FLR (M) before the current PBS expires? Secondly, can she travel abroad with her current visa?

That visa risk being curtailed as she does not meet the requirement any longer.

She will need to switch and wait for another 5 years or 10 Years, depending on the circumstances of your case.

The earlier she switches to FLR(M) the better, as her time as Tier 2 dependant will not count towards her ILR. She will need five years as dependant of a settled person to qualify for her ILR.

Had you got your ILR through Tier 2, she could have continued on as Tier 2 dependant until her five years were up and would have qualified for ILR after five years of being Tier 2 dependant

Wow, I missed that completely. The devil is in the details.

@kev3, please ignore my post if your wife is on Tier 2 PBS herself and is not a Tier 2 dependant (completely different cases). Also, when did she get her current visa and till when is it valid?
