Spouse visa and ILR

SOS ladies and gentlemen,
I have a spousal settlement visa for 3 years expiring in July 2016. I am self employed.We have 2 children at school, the other now waiting for uni.What are the chances or challenges of getting a settlement Indefinite leave to remain visa? Does the £35 000 rule apply.
Your wise counsel is needed.

What is the status of your sponsor? Is s/he a British citizen or on ILR or on PBS?

Typically you need to have spent five years as a dependant before getting ILR.

Thank you for your reply.My sponsor is on ILR. I applied from abroad and was granted a 3 year settlement with our children.

If you applied for "spouse settlement visa" on or after 09-July-12, then you need to spend 5 years in the UK to be eligible for indefinite leave to remain.
You'll need to apply for an extension before your current leave expires.
