cooling off period*

cooling off period*

Hi All,

One of my friend was in TIER 2 ICT from last 3 years, a month ago my friends spouse got TIER2 General and my friend switched to dependant. Now my friend want to switch to ICT General does my friend need to wait 1 yr cooling off period (as he was in T2 ICT till a month ago) to apply or can he apply straight away as dependents doesn't have cooling off period restrictions?

There is no "Tier 2 ICT General", only Tier 2 (General). He cannot switch from dependant to Tier 2 (General).
Understand what switching means.

He will need a restricted CoS and will need to apply for entry clearance from outside the UK.

Hi sushmehta,

sorry its my mistake. You are correct my friend is looking to swich to TIER2 General and he got sponser ready to give Cos and he is willing to go to his home country to apply for entry clearance.
My question is he was on Tier 2 ICT till a month ago now he is on dependant of Tier2 general, can he go out of UK and apply for Tier2 general or does he needs to wait for 1 yr cooling off period to apply??
(as i understood dependents have no restrictions of cooling of period)

This may be stupid question to ask, but...

He will have to wait for 12 months from the day he switched to Dependent visa to apply another Tier 2 visa.
