Husband got his visa!!!

I posted here quite some time ago and I received excellent advice from John and Jeff Albright, just want to say a big thanks to both as my husband recently had a court hearing in Scotland and has been granted a visa!!

You may recall my husband is Pakistani and applied through the british embassy in Islamabad back in November 06. My husband was then asked to attend an interview in February 2007 but did not bring his visa evidence folder with him to the interview due to misunderstanding the interview letter. He was then rejected a visa and told that he had the right to appeal against the ECO decision. My hubby was also illegal in the UK and stayed here for 6 years.

We had our court hearing last week, the judge took 15 minutes to look at the case and was overwhelmed by the amount of evidence we had gathered from the time he applied for the visa to the present day. He asked the Home Office Presenting Officer if she had any questions and she responded by saying that she had no questions and believed the case to be genuine. Furthermore, she said that all the evidence relating to the grounds of refusal letter was there in front of her and therefore she had no reason to doubt the case.

The embassy had refused him due to no wageslips, no bank statements, no proof of me paying NI conts (even though i am working) and no evidence of accomodation. If only hubby had taken the docs with him to the interview, he would have been here ages ago, but anyway he has been allowed the visa. I just hope that the embassy don't decide to withhold the visa for any reason because they have the power to do so according to the AIT.


I'm so glad it is over and for anyone reading this who is going through this nightmare, don't give up!!! Make sure you have as much evidence as you can in the folder and put the evidence into sections ie Our Marriage, Financial, Accomodation etc so that your solicitor can refer to the evidence easily in court. It also makes it easier for you when it comes to organising your paperwork.

Congratulations!!!
Did your husband get his visa already in his passport?
We won our appeal as well it was Sept, 10 and Sept, 21 we got the decision of the Judge that the appeal is allowed. And today HO has last day to lodge appeal against this decision if they want to do it. But I hope everything will be ok.

Thanks guys for the Congrats

We have been sent a determination notice confirming that the appeal has been allowed. It was sent 2/10/07 and the home office had 5 days to appeal. Today is 18/10/07 and the AIT say the status is sitting as Allowed according to their records.

The AIT are informing everyone that the time of issuing the visa is 6-8 weeks but can anyone tell me if there is any way of speeding up the process? I have emailed the high commission today to ask if they have been advised by the HO of the success of the appeal and if there is any way in which we could help/assist them with this matter.

I feel I am on my own now with this appeal. My solicitor hasn't been in contact with me since the court hearing. As far as he is concerned it's over and now its just a question of waiting. Obviously we want to get this visa quickly as my husband has yet to meet his son who is nearly 1 years old.

Is there anyone who can advise me on how to go about getting this visa quicker? Also has anyone won an appeal recently and got a visa quickly from Islamabad BHC.
