How do I bring my mother to the UK?

Post by Mitz » Fri Sep 11, 2015 2:15 pm

hi everyone...

Sorry if I get this wrong - new to it all. We need some advice and hoping someone can help.

My mother has an Indian Passport.
I have a British Passport.

My mother has no family in India and lives alone since my father passed away 2 months ago.

My mother came to visit the UK last month and had a stroke. She is now disabled and cannot eat, walk or look after herself. She is 81 years old and is currently in hospital (as an overseas patient).

I would like her to live with me in the UK indefinitely so that I can look after her.

Is this possible and if so, how would I begin the process?

Thank-you for all your help in advance.

Mitz

Practically impossible, fee is around £2000 and comes with a 99.99% chance of being denied.

The UKVI would want to to spend that £2k etc on affordable care back home I'm afraid.

Does she have Medical/Travel insurance for her visit here? I hope so since otherwise you will receive a nasty surprise from the NHS in the form of a huge bill....

If your mother is medically unable to travel you should seek legal advice.

If you cannot contemplate or take on returning to India with aged parent then how about relocating to Ireland for approx 6 months & shooting for Surinder Singh route to UK?

If she has had a stroke and is in care in a hospital, I do not think the Surinder Singh route is the best way forward as not only will she have to be moved while she is currently suffering a medical condition, but of course the OP himself will need to uproot his life to move the "center of his life" to Ireland.

I would go with Casa's advice. The OP needs professional legal advice. This seems to me to be a case where the Home Office may make a grant of either an Adult Dependant Relative (ADR) visa or Leave Outside The Rules (LOTR).

I do not know if the Home Office needs to factor in the cost to the NHS of the OP's mother's ongoing health care. If they have to factor that in, I would guess that they would at least offer a time-limited LOTR. If they do not factor that in, they could offer a full ADR visa.

To the OP
a) Apart from yourself and your mother, do you have any other family in the UK?
b) Do you have any siblings in India?

Hi Simon, thanks for your reply. Yes I have my sister and that is it. No other siblings in India. Do I just contact the home office by phone?

The Home Office 'help line' is notorious for giving incorrect advice and I doubt whether they will be sufficiently trained to give guidance on what is a complex case. I suggest you seek legal advice first on the best way to proceed.

I agree with the above. Given her age, and what has occurred, it cannot be said that her action in coming with a visitor's visa was pre-planned , and that a change of circumstances did not arise after her entry.

Article 8 outside the rule does not seem bed.

He should seek legal advice and show how you have been supporting your mother.
