Hello,

I am confused re the correct visa application we need to fill in for my husband, and hope you will be able to assist me

I am a British citizen
We got marries 8 years ago
We currently live in the EU. Planning to return to the UK May 2016.

Which visa form should we use?

Ah well! If you are able to show that you (as the sponsor) have been earning the equivalent of £18,600 per annum in the EU state and have a confirmed job offer in the UK to start within 3 months of arrival, again earning £18,600 p.a you could apply for a spouse visa under UK immigration rules. Without income, you would need savings of £62,500. Here's the link:

However, this is involves expensive visa fees, £956 initially + £600 NHS surcharge covering the initial 33 month probationary period. (It's a 5 year route to settlement, and requires an extension, again with a visa fee of currently £649 + another NHS surcharge of £500. An application for Indefinite Leave to Remain (permanent residence after 5 years) is currently £1093, although likely to be increased before your husband has completed the 5 year period.

Alternatively, if as the sponsor you have been 'exercising your Treaty rights' in your current EU country of residence through study or employment you appear to qualify under the Surinder Singh route, which doesn't have financial conditions and your husband wouldn't have to pass the pre-entry A1 level English test. It's also a 5 year route to permanent settlement, with only a £65 fee for formal confirmation of Permanent Residence (PR)

I should have mentioned that if you choose the UK regulations route, you could relocate to the UK ahead of your husband and once you're able to show employment for 6 months meeting the £18,600 pro rata earnings, you then apply for him to join you.

I am looking at the form for Family Member of an EEA National (Surinder Singh Route) and to be honest, it is very very long... we need to fill in travel details dating back ten years.

Which form are you looking at? (the online one?)

In general HMG do play hard ball & impose stringent requirements to their immigration visas.

Surinder Singh is not necessarily straightforward (nor guaranteed) but once you overcome this initial FP hurdle you will be operating within EU rules - a relatively safe haven.

For 10 years travel history, old passports will obviously come in handy.
You could also try requesting a SAR from UKVI which may help fill in the gaps.
