Long resident and pbs dependent

Post by model_309 » Tue Oct 06, 2015 3:35 pm

Hi All,
I was on tier 2 (general) and recently got ILR under long resident route. My wife entered uk as tier 2 dependent in dec 2013 which is valid untill early 2016.
My question is can she apply for settlement as she completes 2 years, also we got married in 2011 which is 4yrs relation.
If she has to extend, which visa does she need to apply for and does she need to take english language test.

Regards,
Model.

Any applications made after 9 July 2012 required 5 years of residence before qualifying for ILR as a dependent. But you have complicated your partners visa process a bit by applying for ILR based on 10 years long residence as now she will have to apply for FLR(M), meet the English A1 test and you need to meet the financial requirement of £18,600pa. She will also have to pay the £500 immigration health surcharge (£200 per year x 2.5 year visa). She will be on a new 5 year route to ILR and the time spent in the UK as PBS Dependent will be lost.

No, she cannot extend her PBS Dependent visa if you obtained ILR based on 10 years long residence, the rules changed in April 2014.
