Good character requirement question

Post by myszakml » Sat Oct 31, 2015 6:43 pm

Hi guys.

I'm about to send my application in a few days and there's something I'm worried about.
About 3,5 years ago I received a Simple Caution because of drunk behavior in a public place. I know that the decision maker shouldn't refuse an application if the person has received a single caution more than 3 years ago. The problem is that about 2 months ago I was unfortunate enough to receive a Fixed Penalty Notice because of a similar reason - drunk behavior. Now, I know that Fixed Penalty Notices are a very minor offences, and receiving one does not form part of a person’s criminal record as there is no admission of guilt. It says that they won't be taken under consideration unless the person reveived more than one of those in the last year.
But it also says that "Decision makers should take into account persistent offending when assessing a person’s character. The overall pattern of behaviour may justify refusing an application, even if the sentences imposed would not normally in themselves be a reason for refusal in line with Table 2.1."
My concern is: Is there a significant risk that the decision makers will take these minor accidents as "persistent offending" and refuse my application even though they're seperated by over 3 years time, and they would not normally in themselves be a reason for refusal in line with Table 2.1 ?
I'll really appreciate your help guys!
