Right to work & expiry of residence visa Non EEA Family mem

Post by Coxy » Sun Nov 08, 2015 8:51 pm

Hi,

Can anyone tell me if is it is necessary to renew a residence visa when it reaches its 5 year expiry date?

My friend is a Non EEA married to a Spanish EEA and both have been working in the UK for the past 7 years. Her residence visa has expired so I'd like to know whether that means her right to work in the UK has expired as well?

Thanks

She doesn't have to renew it as she will obtain Permanent Residency automatically as her spouse has been continually exercising his Treaty rights. However, bear in mind that a PR card is now required when applying for British citizenship, which requires a formal application for PR. Also employers may ask to see a valid document proving the right to work.
