British citizenship and 6 penalty points

Dear All

I am going to keep it short. I was given 3 points in 2012 for defective tires and 3 in 2013 for talking on the phone. In total I have 6 points on my licence. All these points were by means of fixed penalty notices and I didn't go to court. I didn't declare these points when I applied for ILR as they are just fixed penalty notices.

I now want to apply for naturalisation. My question is do I need to declare these points or should I ignore them. I did a comprehensive DBS CRB check on myself in Nov 2015 as part of my job and nothing came up.

Please advise as the guidance notice with the Form AN says that we are required to attach a print out from DVLA if there are any points. My personal view is that because I didn't go to court and that nothing is shown on DBS CRB I don't need to declare anything.

Fixed penalty notices are not convictions, however the AN Guide states:
SECTION 3: GOOD CHARACTER
3.1 – 3.2 You must give details of all criminal convictions both within and outside the United Kingdom. These include road traffic offences. Fixed penalty notices (such as speeding or parking tickets) must be disclosed, although will not normally be taken into account unless:
• you have failed to pay and there were criminal proceedings as a result; or
• you have received numerous fixed penalty notices.
Drink driving offences must be declared. If you have any endorsements on your driving licence you must access the DVLA website to download and print a summary of your record and send it with your application. Please note that a driving conviction may not be disregarded despite any penalty points being removed from your driving licence.
So you should declare it.

Rules for immigration (upto and including ILR) and citizenship are separate and unrelated.

Ohara has pointed out a very specific and relevant part of the Guide AN and I would go with that.

Hi everyone

By the grace of God, I today received my approval letter.

I applied through NCS Ealing.

I attached a print out of my 6 points with the application.

The NCS lady told me that as long as there are not more than 3 points in last 12 months, there won't be much of an issue.

She also said that expect a decision within 2 months.

I applied on 25 January 2016 and received approval on 11th March 2016 (Dated 7th March 2016).

I also attached a print out of my comprehensive CRB
DBS with the application.

In all it took 6 weeks from start to finish.

Anyone in my situation should find this helpful.

You can do it through DBS Scotland. I think they charge £25 and you receive in 2 weeks

You can do a basic disclosure through Disclosure Scotland. I believe enhanced disclosure can only be done by companies.
