EEA divorce/ what now?

Post by rise » Sat Feb 06, 2016 2:06 pm

Hi I all, i have had the eea residence permit since 2012 and got divorced after 3 years and 9 months. i cant find the form online for the right of retention after divorce.it just takes me to some online application page. i need some advice. Does the 1 year requirement for the eea citizen to exercise treaty rights by being employed have to be continous 1 year of employment within those 3 years of marriage?? i was cheking the ukba website and i couldnt find any information about it. i am a bit nervous cos its all complicated. also i will be completing 10 years in the uk soon but dont know if my application will be refused if i try the 10 year ILR route as i am divorced now and there is still 4 months to complete 10 years. so where can i find the form for the eea route for ror and is there anything that has changed in the last year . any new laws or requirements?
thank you for all your help
thanks

Yes you will.
For example see pages 5 & 9 in the guidance notes; (linked above).

There are mechanisms to deal with cases where evidence is missing due to an estranged partner.

See more detailed guidance here:
https://www.gov.uk/government/uploads/s ... _clean.pdf
- for example, see pages 15, 21, 31

hi noajthan, thanks for your reply. just one more question. when i apply for ror , what evidence do i need to provide that my eea spouse was exercising their treaty rights. is it one year of employment? also, does that one year of employment needs to be near the divorce date or can it be anywhere within the 3 years of marriage. pls advice. thanks
