Switching from Tier 2 to unmarried partner visa

Post by LMMW » Mon Feb 22, 2016 9:30 pm

Hi :)

I'm currently on a Tier 2 (General) visa, and planning on switching to an unmarried partner visa.

My partner and I have been living together for over 2 years, we have a joint bank account and tenancy agreement for the place we currently live in. We are getting married in Aug this year, we have already booked the registrar with the local council and got the letter from HO to confirm that they will not conduct an investigation for a sham marriage.

My questions are:
- if I apply for a partner visa now base on the fact that we have been living together for more than 2 years as unmarried partners, do I need to change my visa once we are married?

- do I need 2 years of consecutive tenancy agreements to prove we have been living together? Are there any other documents that I can use to prove?

- I will be eligible to apply for ILR (10-year route) next year, if I switch to a partner/spouse visa would it reset the time I need for ILR?

Many thanks in advance for your help! :)

1. No, you will need to update your BRP card if you are female and changing your name.

2. As much as you can. You need documents from 6 different sources, roughly every 3/4 months for 2 years.

Not if you are applying on the basis of 10 years legal residence from the date of your arrival in the UK.

6 piece of joint or 12 pieces of individual .

As you came in as a PBS migrant , your close starts from when you were issued your visa , provided you enter the UK within 3 months of this period..
