Please advise: Guidance on my son's ILR

Dear All,

I am on Tier 1 General Visa since Jan 2011. Me and my wife are going with the ILR application in Jan 2016.

My son who is 3.5 years old was born in India and has been in UK on PBS dependant visa since March 2012. He has a valid Tier 1 general visa until March 2018.

My question:

I would like to save some money and hence please can you advise:
1. If me and my wife apply for ILR in Jan 2016, can he still remain legally in UK on PBS dependant visa (which is valid until March 2018)?
2. When me and my wife become British Citizen in Year 2017, can he directly apply for citizenship without applying for ILR?

I was told by an agent that he has to apply for ILR before becoming citizen as he was born in India. I am reluctant to spend £1500 on his ILR application if I can avoid.

Please help.

Child's ILR

Hi All,

Please can you let me know which form I should use for my son's (3 year old) ILR application?

Me and my wife already have ILR visa. (5 years T1 General route)

My son is on PBS dependant (T1 Dependant) visa valid until 31st march 2018.

Should i use Set(O) or Set(F)?

Query regarding child's ILR application

Hi All,

I am in process of applying my son's (4 years old) ILR.

Q1. His Indian passport will expire on 27th July 2017. Is it fine if I send the Postal application before 27th Jan this month? It will have 6 months validity when it reaches Home Office.

Q2. I also need to apply for British Citizenship this month. Is it necessary to send sponsor's (my) original passport and BRP with my kid's ILR application or copies of all pages of my passport and BRP is fine for his application?
