Basically, I got married 18 months ago to my wife, she applied for Discretionary Leave to Remain the home office initially rejected her and it went to appeal, we got the result and the appeal was rejected. The argument the home office used in the court was I get Carers Allowance for my father they said she can just go back and apply as a spousal and she can be here in 2 months.
Basically, I get Carers Allowance £62.10 and Income support £91.20 every 2 weeks, which totals £107.70 a week. I have seen that I don't need the minimum income as I get Carers Allowance.
When my wife got married, we used to live in the family home, but since then my sister had to sell up the house. So we are in rented accommodation with my mother who gets housing benefit, my sister lives also in rented with her husband. She has paid the rent on the house we live in for the past year.
She wants to buy a house and we will all move in there. She had to sell up as it was a joint house and the other party wanted his money. Me and my sister has supported my wife while she has been here for 18 months.
So my wife has to go back now and apply for spousal, do you think I will have any issues. Also should my sister supply anything to support the application. E.G proof that rent has been paid, she earns over 50k and has over 100k in savings.
