Unmarried partner visa- length of time apart

Post by harpy61 » Sun May 22, 2016 2:04 pm

I am a UK citizen who was a graduate student in the US, and am in a long-term relationship with a US citizen. We lived together in the US between 2010 and 2015, However, I had to return to the UK in February 2015 when my student visa ran out, and we have been in a long-distance relationship since then. We have had several visits over the last year, and have been in regular, almost daily contact on skype. From my reading of the guidance, this would not fulfill the guidelines for him being granted an unmarried partner visa, since I read that separations of this kind should be no longer than 6 months. Is there any flexibility here?

Not for such a long break in co-habitation over the permitted 6 months.

No flexibilty at all I'm afraid.

We were apart for a year, me in UK, her in Germany, I was over there every weekend and I was advised that's not enough to keep the UPV period active, so we took the prudent option and waited.

This was 2005, things have tightened up considerably since then too.
