Appeal Tips

Post by gaugupta » Wed Dec 12, 2007 7:35 pm

Hi All,

There are only 3 Option If your Entry clerance is refused.

1. Re-Apply means Fresh Application.
But Make sure you cover all the things/grounds which overcome your last rejection.

2. Appeal at Post who has Rejected Your Visa.
If you go for these option. You need to sent originals copy of all supporting documents which are supporting you refusal comments. But make sure that you talk first with High Commision what all things you can provide. Also as per general guidance by UK Mission ECO has to review appeal in 20 working days.If his decision still not in your favour then they sent it AIT for Lodge. So If you think that you missed something with earlier application and sent now with Appeal it will take less time. If ECO is not satisfied then it will go to AIT which will take time minimum 3- 6 Months.

3. Appeal at AIT.
If you are filing appeal with AIT then minimum time for that is also 3- 6 months. But make sure you sent all documents originals. If you have someone in UK who can just go on hearing date and show your documents to Judge then also its in your favour or you can ask for paper hearing.

Also with your appeal you can give covering letter explaining why you think decision is wrong. Also read HSMP Guidance Note while appealing mention those rules in covering letter which are in your favour and your grounds.

If you don't have additional documents to submit then you can Fax also your appeal. Remeber whatever you have given with earlier application of EC they keep a copy of that so just be carefull while submitting any documents

Thanks

Gaurav
