EEA Family Permit 6 months

Post by hostwiz » Thu Aug 17, 2017 9:22 am

Hi therr,
first apologies if that had been answered before here.

My wife's eea family permit is about to expire and I read that after that period she is expected to apply for the 5 year one. My question is are we required to do that or she can keep living here with expired one? Can she exercise treaty rights as a family member of a eu national and how do we proof that given the 6 months family permit expired?

Any help will be appreciated

Kind regards

The residence card (to be requested DURING the six months of EEA FP) is exactly to prove that she is a FM of an EEA citizen exercising treaty rights. Without residence card she will not be illegal in the country but it's basically impossible for her to get a job and if she leaves the country it will be hard for her to get back in.

Thanks Dan,

I am reading the hm site :

Stay after your EEA family permit expires

You can stay in the UK after your permit expires if you:

are the family member of an EEA national - see if you’re eligible
qualify for a ‘Surinder Singh’ application
have a retained right of residence
have a derivative right of residence

You can apply for a residence card card or derivative residence card to confirm your right of residence. You don’t have to apply but it will make it easier to prove your right to live and work in the UK.

That makes me think there is a way to proof that, I am just not sure how.

Kind regards
