hi,
shah please my brother has got IELTS band 6 as well but now hmsp holders are suppose to get 6.5,
he got 6 when there were rules to get 6 so he got in advance although he is suppose to apply after 3 months. so what should he do either he should appear again in IELTS OR he could qualify with band 6 because h.o advised the people to qualify with 6 band in past that was announced to be valid for two years.
regards.

Hi Mughal
If ur bro is in uk and applying for leave to remain or extention then he comes under TIER 1 and to my knowledge for extention language suitability is not required. and if he is outside UK then he is to file his case as per old HSMP 08/07 guidline that requires 6 band `coz right now TIER 1 only applies on UK residents. and if he gets HSMP approval then at the time of EC he will not be asked for IELTS gain even if he reaches to Uk and definitely applies for extention under TIER 1 after 2 years the language criteria doest apply on extention. Please note that TIER 1 is coming in india from 1 April and rumors are there for pakistan also so hurry up, other wise as per TIER 1 6.5 band wud be required, by the way in TIER 1 not only IELTS they have also included other easy test please see Guidline.

Check this out http://www.bia.homeoffice.gov.uk/workin ... angements/

""If you apply with a valid HSMP approval letter, you are charged a reduced Tier 1 (General) - highly skilled worker fee for your application. Read the section on costs to work out the fee you must pay.

If you have been issued with an HSMP approval letter, you must now make a Tier 1 (General) - highly skilled worker application. You are automatically awarded the 75 points required to qualify under the attributes points assessment of Tier 1 (General) - highly skilled worker and will not need to show you meet the English language requirement.

You do not need to fill in the attributes section, so you can go straight to the maintenance section of the application form.

If you already have a valid HSMP approval letter, you should go to the maintenance section of the points assessment and complete the rest of the application form.""

Please also read the last paragraph

Transitional arrangements for extension applications by existing highly skilled migrants

Hope it might help you

Best of Luck
