Income Requirement for ILR of a Dependent for British Citizen

Hi All.

Couple of quick questions:

To apply ILR under 5 year route for a dependent of British Citizen, the income requirement is £18600 over a period of any 12 consecutive months within last 15 months from the date of application. This income can be shown either from only main applicant (or) dependent applicant (or) a combination of both the applicants.

Q1) If the dependent is on SMP (Maternity Pay - being paid by a limited company). Are we allowed to show this pay as an income (guess this is not usage of any public funds) ?

Q2) Can we show 12 months pay for the main applicant and only 3 months pay for the dependent ?

SMP is not public funds
Q2) Can we show 12 months pay for the main applicant and only 3 months pay for the dependent ?
No. It is 6 Months if you were employed by one employer and 12 months if you changed your employer

Hi All

Can anybody who is on a Dependent Visa apply for a Family Visit Visa while in UK to extend the stay?

The reason for opting the above route is because the person's Dependent Visa is going to be expired but he/she is not eligible for dependent renewal due to the spouse (main applicant - British Citizen) income is not sufficient.

No they cannot apply to extend as a 'visitor'.

If they don't meet the financial requirement, then they would need to apply on FLR(FP) 10 year Partner route.

What is the annual income for both of them?

Surely they knew they had to meet the same financial requirements at the time of extension PLUS English A2 level?

Thanks for the prompt response.

The income requirement for both ILR & FLR are same i.e., £18,600 which the main applicant (British Citizen) was unable to meet due to personal family reasons. In this scenario, how would the dependent be eligible/go for 10 year route visa ?

Currently, the dependent visa expires on 15.05.2018. Can the dependent fly to to India before the expiry and then apply for ILR at a later date from India (may be in June or July) as the main application would then be able to successfully meet the income requirement.

Is the dependant a partner or child? If refering to wife, then no.

My wife completes five years on dependent visa by 02/02/2018 but the visa expires on 15/05/2018. Can she go for ILR towards the end of this month ?

Does the 28 days apply prior to date of visa expiry or prior to completion of 5 years?

Is your wife pbs dependent? What date she entered in the UK?
