I was until recently an asylum seeker but i have got my ILR.
The problem now is that my husband has been in UK for 4 years ,he overstayed his transit visa.we married outside uk
Now we want to get our life sorted out and start living as husband and wife officially.we are have 2 kids both with ilr.
we do not know what to do

Before delving further into this, can you say which country your husband is from? And would it be possible for him to return to there and apply for a spouse visa?

The answer to the second question? Or put it another way, any reason why he could not return, to apply for the spouse visa?

The only reason is that ,I am scare having overstayed here might affect his chance of getting spouse visa .secondly I am not sure If have enough ground to support him if he made application for the visa.I am currently not working ,and am on benefits raising up 2 kids on my owne.t.c

Be aware that from October there will be an automatic ban for a period of time on people that have infringed UK immigration law. Things are only going to get worse if he delays.

The financial matter ... prior to leaving is your husband able to get a job offer, effective from when he returns on a spouse visa? If he is able to get such a job offer, then it could make all the difference.

How old are the children? And what benefits are you currently claiming?
