got approval - need help on EC

Post by kashifmalik » Thu Dec 23, 2004 2:43 am

hi everyone,
I have been a silent listener to this forum, i applied on the 28th of May & got my approval letter on the 10th of Dec..Thanks to everyone here, coz without your help & postings i would never had made it...
now the big question, i am working in East Timor with UNDP (my country of residence is pakistan) on a contract which will expire on the 11th of august 2005. can i delay my entry to UK till august 2005? is that possible? because i dont want to leave this job in the middle but likewise i also want to go to UK as well?
your suggestions in this regard will be highly appreciated.

you need to be aware of the extension requirements, you will need to show that you have been economically active or at least you have taken steps to get a job in the UK. Arriving in august leaves you with 3 months to get a job before having to apply for renewal, not impossible, not an inmediate probelm with HO but it will leave the door open for them to deny your renewal request.
My suggestion, travel asap, get a new job here and then renew the HSMP.

Congratulations Mr. Malik, u will have to apply for EC within 3 months from the date mentioned on your approval letter. Then u may take another 3 months to enter UK. So, if you (suppose) apply for EC in march and get EC in the same month then u will have to depart till 90 particular days from the date of visa issued in march (if it is stamped in march).
These are the physical conditions to enetr UK, but what these delays impact your FLR are discussed in the reply of try-one.

Thanks Try-one & Mobig for the response...What is the rule related to the initial 1 year of HSMP. When does the time period of 1 year start ticking on the clock. is it the date of issue of approval letter, in my case its 10th of Dec 2004.?or what? What my understanding is, that the initial 1 year starts the day you land in UK.e.g. i wanted to go in August 2005, so from aug 2005 to aug 2006?
My current job is to last till August 2005. Iwill get an extension of further 6 months in Feb 2005, which lasts till August 2005. I can only resign in may 2005, if i want, not before (due to the nature of the project). So what i have planned is that i get the entry clearnace in March 2005 & then travel to UK in june 2005 (assuming i resign in may 2005).
What i presume is right here? or otherwise?

Plz see this post from Cosmopol, quoting Justin-W: http://www.immigrationboards.com/viewto ... c&start=30

please comment in detail on this point, i'll be grateful.

This time period starts from the date of visa stamped in your passport, as per your planning, you may easily manage to enter UK within your prescribed time.
If you apply in early march (9th march will be your last day), then you will be looking for your visa stamp, there is no calculated time for this process, it differs worldwide. When you get visa after applying, you will have another 90 days to enter UK. These are the 90 days among 365 days of your visa. As much you can avail are 90 days only. It means you have to spend at least 9 months in UK......clear..!!!

Mobig,

There is one confusion - We normally get visa for one year and we have to enter UK any time in that one year. there is no
such restriction that you have to enter UK within 3 months of visa start date or you have to be in UK for atleast 9 months.
Only thing is that if we enter late visa extension will be difficult.

Pl reply.
Bye

Yes Ofcourse there is no such restriction but, you have to face difficulties after that 90 days period in my experience. I wrote all above for a normal validity period which he can avail without any problem :)
