Naturalisation for kids after being granted ILR

Post by asii » Sun Nov 18, 2018 12:09 pm

Hi good people,

I was wondering if you guys could point me in the right direction, I have just been granted my ILR via long lawful residence, I would like to know if kids (born in the UK) also need to wait for 12 months before being able to apply for naturalisation?

Moreso, my dependant partner has about 4 months left on her visa, which was what I was on before being granted ILR, I would also like to know if she has to change her visa asap or can use until it rans out?

I shall be waiting for response please.

Many thanks

No. UK Born children have an entitlement to register as British under Section 1(3) of the nationality act once EITHER parent is granted ILR.

As you got ILR based on long residence and not PBS route, your partner has to switch to FLR(M), which will reset their clock to zero and a new 5 year route to ILR (2 x 2.5 year visas) unless partner reaches 10 years long residence first.

Hi there,
Thank you for your response.
I sort of struggled to get view this post as I couldn't find a link to "my post".

I have one more question dumb question, I read through the requirements for the referees, however, its didn't say whose photo should be on the form signed by the referee. It just says photo, and referee should sign. I believe it should be that of the kids?

However, I don't want to stupidly give the H.O any reasons to turn down the application, hence why I called it a dumb question.

Thanks all.
