Enquiry: ILR parent and new born child ?

Post by krishnan2987 » Wed Nov 28, 2018 4:51 pm

Hi All,

Me and my wife are expecting a baby in mid of June 2019. I'm currently on Tier 2 general and it expires on Nov 2019 and I have also completed 5 years in Tier 2 general and now eligible to apply for ILR.
My wife is still on Tier 2 general dependent visa and she completed 4 years.

I have got 2 questions:

1. Should i apply for ILR before the baby is born so baby is directly eligible for UK Citizen, or wait until the baby is born and in that case what other options have i got?

2. Should i apply for PBS extension for my wife after i get my ILR or do i need to process my ILR application along with my wife's PBS extension.

PS: Should i need to wait until march 2019 to see if any visa rule changes after Brexit?

Thanks,
Krish

If you have ILR when the baby is born, the child is automatically British and can apply for a passport directly. If you only get ILR after the baby is born, the child is NOT British and you have to register the child first on form MN1, costs £1033 at present, passport is separate to this.
2. Should i apply for PBS extension for my wife after i get my ILR or do i need to process my ILR application along with my wife's PBS extension.
She must apply for an extension after you get ILR but before her current visa expires. It will be a 3 year extension. Note that IHS fees are doubling in December to £400 per year so you would have to pay £1200 IHS plus the visa fee.
PS: Should i need to wait until march 2019 to see if any visa rule changes after Brexit?
Brexit has nothing to do with the UK immigration rules. It affects EU citizens and their dependents.
