Work Permit Application Withdrawal

Pleasse help,

I am currently on work permit as a hotel Front Office Manager and recently decided to change employment. I was offered a similar job by a different employer and applied for new work permit through a consultant. Unfotunately due to some reason my application was filed a week later than expected and till now a case work has not been allocated on my application. It is now nearly one month since my application reached Home Office.

Now my new employer is giving me pressure to withdraw my application from HO due to lack of time.

1. Will there be a problem if I withdrew my application?
2. Will it affect my future application?(I have interviews coming up)
3. Does anyone know that how long are they taking now to make a decision on work permit application?

Related question.
4. Now I am applying for jobs in IT in Hospitality (Support position for Property Management sys) for which I have two interviews coming up. Is it allowed to change my employment from a Hospitality Management role to Hospitality IT role.

Dear friend,

First things first, you do not withdraw your WP application, your Employer does it because they are the ones who apply for it in the first place.

Secondly, before change in employment, unless you currently hold a WP in the same position with the same skill set - then the advertisement criteria is waived off.

If your job title and skill set differ from your original WP
Your new employers have to first advertise for the position and first try finding someone within the EU for that position, if they are unable to find someone from the EU then they have to satisfy WP that you are best candidate.

If your job and skill set remain the same
Then your new employers can apply for a new WP for you without fulfilling the advertisement criteria.

If all documents and application is in order WP UK will get back to your employers within a week or so. But always remember, your employers apply for your WP and not you.

Thank you very much for your reply.

Yes my employer has asked the Work Permit consultant to withdraw my application and I just contacted the Sheffield office and they are waiting for an email/letter from the Work Permit consultant to confirm it.

I am sure that I will lose my fee that I paid for the HO. However can you please advice that my new employer's decision to withdraw my wp application will any way affect my future wp application?

Also, when I first joined my current company I was recruited as a Head Receptionist. Then I was promoted to Front Office Manager. But in home office records I am still a Head Receptionist.

HO requires my updated CV in which it reads my current postion as FOH manager. Will this become a problem?

No, it will not affect any of your future applications.

You will need to get permission from the UK Border Agency if:

1. you would like to employ a person who already has a work permit for a job, training, or work experience with another employer; or
2. you want an existing employee to change posts within your organisation; or
3. the person has a change to the duties and conditions of work from those on the previous work permit application.
