When to apply for a spouse visa.

Post by mobrien » Fri Nov 30, 2018 10:40 pm

Am i right in thinking you can only apply for a spouse visa 3 month before your intended date of travel or is this rule only applicable for visitor visa's?

You can't ask for the issue date to be deferred any longer than 3 months.

Ok thank you. What exactly does that mean? We aim to travel back to the UK from New Zealand on the 25/5/19. We initially intended to apply for a spouse visa on the 25/2/19 (3 month before intended date of travel). Can we apply for it earlier than our initail planned date of application?

You can, but once the visa is granted, you will only have 30 days in which to enter the UK on the temporary visa vignette and then collect the BRP from the designated Post Office.

You can only ask for the issue date to be deferred for a maximum of 3 months from the date the application is submitted.

Just one additional point....under which financial category are you relying on if you are both living outside of the UK?

Thank you now I understand. We are relying on financial category A. Have been with current employer greater than 6 months and have a job offer in the UK starting within 3 months of planned arrival (1st June), earning more than 18600 in both jobs.

First, the applicant’s partner must have a confirmed offer of salaried or non-salaried
employment to return to in the UK (starting within 3 months of their return). This must
have a gross annual starting salary (or in non-salaried employment a gross annual
income from that employment, based on the rate or amount of pay and the standard or
core hours to be worked provided by the employer in evidence) sufficient to meet the
financial requirement, alone or in combination with any or all the sources at section
5.3.6. (Category C: non-employment income, Category D: cash savings and Category E:
pension).
5.4.3. Second, the couple returning to the UK must in addition have received in the 12
months prior to the date of application
the level of income required to meet the
financial requirement
,
based on:
 The gross amount of salaried or non-salaried employment income overseas of the
applicant’s partner

What is the most appriopiate way to organise supporting documents for a spouse visa. I believe that the home office do not like documents which are stapled or paper clipped. How do they feel about the use of polly pockets, post it notes or other forms of tools to help organise the supporting documents?

Hi,

I have a question regarding accommodation.

I have been offered a job in the UK that also comes with a house rented on our behalf. To meet the accommodation requirements of a spouse visa is a no objections letter from the landlord and also a tenancy agreement sufficient or should we also provide a housing report. The house is a two bedroom house that will only be occupied by myself, spouse and two children both under 5 years old. Also the tenancy agreement states that no bonds is required and that the monthly rental is 25 pounds per calendar month, would a letter from our employer stating why this is be enough to avoid the case officer thinking this isnt a genuine agreement?
